Terms of Service

These terms govern your use of Drate: the websites creators build with it, the memberships they sell, and everything in between. They’re written to be read, not skimmed, but here’s the short version: be honest, don’t abuse the platform, and respect the people on the other side of every membership.

Agreement to these terms

By creating an account, building or publishing a site, joining a creator’s membership, or otherwise using Drate (the “Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you’re using Drate on behalf of a company or other organization, you represent that you have authority to bind that organization, and “you” refers to it.

If you don’t agree to these terms, don’t use the Service.

The service

Drate is a platform for creator membership websites. Creators use it to build a website on their own domain, publish content, sell memberships and passes, run a member community and take bookings. Members use those websites to read, watch, join and take part. Drate provides the hosting, site tools and billing integration; each site and what it publishes belong to the creator who runs it.

We’re continually improving the Service, which means features may be added, changed, or removed over time. We’ll use reasonable efforts to give notice of changes that materially reduce functionality you’ve paid for.

Accounts

Creators need an account to build and publish a site. Members need an account to join a creator’s site. You’re responsible for the activity that happens under your account and for keeping your credentials secure. Creators can invite teammates to help run a site; the site owner is responsible for the activity of the people they invite.

  • You must be at least 16 years old to use the Service
  • You must provide accurate registration and billing information
  • One person or legal entity per account, unless we agree otherwise
  • Notify us promptly if you suspect unauthorized use of your account

Joining a creator’s site

Memberships, passes and other purchases on a creator’s site are sold by that creator, not by Drate. Each one is listed with its price and what it includes before you pay. When you join, you receive personal, non-transferable access to that creator’s member content for as long as your membership or pass is active. You’re getting access, not ownership of the creator’s work.

Recurring memberships renew automatically until cancelled. You can cancel any time from your account; access continues until the end of the current billing period. Fixed-length passes are a single payment for a set period and do not renew. Refunds are decided by the creator who sold the membership. If something isn’t as described and you can’t resolve it with the creator, contact us and we’ll help.

Running a site on Drate

Anyone can build a site on Drate. As a creator, you’re responsible for what you publish and sell:

  • Your site and your plans must accurately describe what members get
  • You must deliver what you sell for as long as a membership or pass is active
  • You must have the rights to everything you publish: writing, video, audio, images, downloads, and anything you embed
  • Your site must not violate the acceptable-use rules below
  • Payments go to your own Stripe account; you must complete Stripe onboarding and keep your account in good standing
  • You are the seller to your members, and you’re responsible for refunds, member support and any taxes on what you sell
  • If you connect Patreon, a booking calendar or another outside service, you’re responsible for following that service’s terms
  • You must own or control any custom domain you connect

We may unpublish or remove sites or content that break these terms, mislead members, or create security or legal risk. Where practical we’ll tell you why and give you a chance to fix it.

Plans, fees, and billing

Payments are processed by Stripe; Drate doesn’t store your full card details. Members pay creators directly through the creator’s own Stripe account, and Drate never holds a creator’s money.

Drate is free to start. On the Free plan we take a platform fee on the memberships you sell. On the Pro plan you pay a subscription and we take no platform fee. The current fee and subscription price are shown on the pricing section of our homepage and before you commit to any charge. Stripe’s standard payment processing fees apply on both plans and go to Stripe. Applicable taxes may be added based on your billing address.

Pro subscriptions renew automatically until cancelled. You can switch plans at any time from your dashboard. If a payment fails, we may retry it and suspend paid features until the balance is settled.

AI features

Some features use AI models to generate drafts for you to review. AI output is generated, not authored. It can be wrong, incomplete, or unsuitable for your purpose, and you’re responsible for reviewing it before you publish or rely on it.

Your content

You own the content you bring to Drate: the posts, videos, audio, files and pages you publish as a creator, and the posts, replies and messages you write as a member. You grant Drate a limited license to host, store, transmit, and display that content as needed to operate the Service. Members additionally grant the creator whose site they post on the right to display those posts within that site.

Creators keep their relationship with their members. We don’t use your private content to train AI models. See the Privacy Policy for the details of what we collect and how it’s used.

Acceptable use

You agree not to use the Service to:

  • Break the law, or publish content that helps others break the law
  • Distribute malware, phish, scrape credentials, or interfere with other people’s sites, accounts or data
  • Probe, scan, or test the vulnerability of the Service except through our authorized disclosure channels
  • Circumvent access controls, billing, or platform fees, including sharing paid content or account access outside a membership
  • Generate spam, harassment, or deceptive content at scale
  • Misrepresent who you are, who runs a site, or what a membership includes
  • Infringe anyone’s intellectual property, privacy, or publicity rights

We may investigate suspected violations and remove content, suspend accounts, or involve law enforcement where appropriate.

Intellectual property

The Service itself (the Drate platform, brand, design, and infrastructure) belongs to Drate. These terms don’t grant you any rights to use the Drate name or logo except to truthfully describe your use of the Service. Joining a creator’s site lets you view and use that creator’s content for your own personal use. It does not transfer ownership of the creator’s work, or grant any right to redistribute or resell it unless the creator expressly allows it.

If you believe content on a Drate site infringes your copyright, send a notice to support@drate.app with enough detail for us to find and evaluate the content.

Third-party services

Sites on Drate may connect to third-party services, such as Stripe for payments, Patreon for existing patrons, a booking calendar, or a video host. Those services have their own terms, and your use of them through Drate is your responsibility. Drate isn’t liable for third-party services we don’t control, including outages or changes that break an integration.

Creators can share their videos to YouTube or TikTok from Drate. By connecting YouTube, you agree to the YouTube Terms of Service; by connecting TikTok, you agree to TikTok’s Terms of Service. You’re responsible for having the rights to everything you share.

Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, Drate disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, or that any site or membership will meet your requirements. Sites are run by independent creators; Drate doesn’t review everything they publish.

Limitation of liability

To the fullest extent permitted by law, Drate will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Service. Our total liability for any claim is limited to the greater of one hundred dollars (USD $100) or the amount you paid Drate in the twelve months before the claim arose. Some jurisdictions don’t allow these limits, so they may not fully apply to you.

Termination

You can close your account at any time. We may suspend or terminate your access if you materially breach these terms, create risk or legal exposure for us, or if we discontinue the Service. After termination, sections that by their nature should survive (including payment obligations, content licenses needed to honor active memberships, disclaimers, and liability limits) survive.

Changes to these terms

We may update these terms as the Service evolves. If a change is material, we’ll give notice (by email or in-product) at least 14 days before it takes effect. Continuing to use the Service after a change takes effect means you accept the new terms.
